Hereinafter referred to as the "Seller" or the "Company" on the one hand, and the natural or legal person purchasing the ACMOS Bioenergetics training and its advanced courses and its complementary cycle in Scientific Geobiology from the company,
Hereinafter referred to as the "Buyer", or the "Client", or the "student", or the "trainee" on the other hand, the following has been stated and agreed:
PREAMBLE
The Seller, SBJ INTERNATIONAL, is a training organization for the ACMOS Energy Balancing Method or ACMOS Bioenergetics as well as for complementary advanced courses in Geobiology and Naturopathy, services exclusively intended for consumers (trainees or students).
The list and description of the training courses provided by the Company can be viewed on the aforementioned website.
The applicable general terms and conditions will be those in effect at the time of delivery of the training courses.
The training courses in question refer to the training courses offered in the SBJ INTERNATIONAL catalog and on the SBJ INTERNATIONAL website.
Article 1
Purpose and Scope of Application
These General Terms and Conditions of Sale govern the rights and obligations of the parties in connection with the sale of training courses offered by the Seller. These General Terms and Conditions of Sale apply to both in-person and distance learning courses. In-person training courses may be conducted at SBJ INTERNATIONAL's premises, in premises rented by SBJ INTERNATIONAL, or at the client's premises.
Article 2
General Provisions:
These General Terms and Conditions of Sale (GTC) apply to all training sales on the formation.acmos-sbj.com platform, made to SBJ INTERNATIONAL, which are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The applicable General Terms and Conditions are those in effect on the date of payment (or the first payment in the case of multiple payments) for the order. The Company also ensures that their acceptance is clear and unconditional by providing a checkbox and a validation click. The Customer declares that they have read all of these General Terms and Conditions of Sale, and, where applicable, the Special Terms and Conditions of Sale related to a training course, and accept them without restriction or reservation. The Customer acknowledges that they have received the necessary advice and information to ensure the suitability of the offer to their needs. The Customer declares that they are able to enter into a legal contract under French law or validly represent the natural or legal person for whom they are committing. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Article 3
Price:
The prices of training courses sold through SBJ INTERNATIONAL are indicated in Euros (€) inclusive of all taxes (VAT + any other taxes) and are precisely determined on the training description pages. For all training courses ordered outside the European Union and/or French Overseas Territories, the price is calculated based on the legislation in force in the client's territory.
The Company reserves the right to modify its prices at any time for the future. Connection fees required to access the Company's website are the responsibility of the Client.
Article 4
Conclusion of the Training Contract:
The Client must follow a series of specific steps for each training course offered by the Seller in order to complete their order.
However, the steps described below are systematic:
The Customer will receive an order confirmation email listing all the items ordered,
For the proper execution of the order, and in accordance with Article 1316-1 of the French Civil Code, the Customer undertakes to provide truthful identification information. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.
Article 5
E-learning Specifics:
SBJ INTERNATIONAL grants the Client a non-exclusive, non-assignable, and non-transferable license to use its distance learning content, hereinafter the "Module".
All Modules will be made available to the Client on the e-learning portal, formation.acmos-sbj.com, after acceptance of the General Terms and Conditions of Sale and acceptance and payment of the order.
The Client will have a period of 3 years (1095 days) from the start of the training to use the Module user licenses. Solutions will be offered to extend this period.
After this period, the granted user license(s) will cease to be available :
In the event of the LearnyBox platform ceasing operations, replacement solutions will be immediately implemented to allow users to continue their training and download the documents related to the module(s) ordered.
Article 6
Intellectual Property:
The digital media (in PDF, image, or video format) distributed and offered for download on the ACMOS training platform are the property of SBJ INTERNATIONAL. This, in its entirety, both in its presentation and its content (in its entirety or separately), direct or indirect, regardless of the form. All media are protected by applicable intellectual and/or industrial property laws.
Any reproduction, distribution, communication, representation, reuse, and adaptation, whether in part or in full, in any form whatsoever, or any recording, whether in audio and/or video format, is prohibited without the express prior authorization of SBJ INTERNATIONAL or its rights holders. Any such reproduction constitutes an infringement and is therefore subject to the penalties provided for by law.
Article 7
Payment:
Payment is due immediately upon ordering. The Customer can make payment via the following secure payment solutions: PayPal, Stripe, GoCardless, or by bank transfer. Cards issued by banks domiciled outside France must be international bank cards (Visa, Mastercard, American Express, or others).
Secure online payments by credit card or bank transfer are made by our payment service providers. The information transmitted is encrypted according to industry standards and cannot be read during network transmission. Once the Customer initiates payment, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing their banking information during the sale, the Customer authorizes the Seller to debit their card for the amount corresponding to the indicated price. The Customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it. In the event of an error, or if the card cannot be debited, the Sale is immediately terminated and the order canceled.
Article 8
Withdrawal Period:
In accordance with Article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days to exercise their right of withdrawal without having to provide a reason or pay any penalties, with the exception, where applicable, of return shipping costs." We inform Customers that in accordance with Article L. 121-20-2 of the French Consumer Code, this right of withdrawal cannot be exercised for security deposits for registrations for ACMOS training courses and seminars.
Refund procedure: Refunds will be made upon receipt of the returned products, by credit card (the payment method used for the initial transaction), PayPal, or by voucher redeemable on our website.
Article 9
Subcontracting:
SBJ INTERNATIONAL is authorized to subcontract, in part or in full, the performance of the services covered by this contract. All of the Customer's obligations arising therefrom are only valid with respect to SBJ INTERNATIONAL, which remains liable to the Customer for all obligations arising from this contract.
Section 10
Force Majeure:
The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of an unforeseeable event or force majeure that would prevent its performance. The seller will notify the customer of the occurrence of such an event as soon as possible.
Section 11
Invalidity and Amendment of the Contract:
If any of the provisions of this contract are canceled, such invalidity shall not invalidate the other provisions, which shall remain in force between the parties. Any contractual amendment is only valid after written agreement signed by the parties.
Article 12
Protection of Personal Data:
In accordance with the French Data Protection Act of January 6, 1978, you have the right to query, access, modify, object to, and rectify your personal data.
By agreeing to these general terms and conditions of sale, you consent to our collection and use of this data for the performance of this contract.
By entering your email address on our website, you may receive emails containing information and promotional offers regarding products published by the Company, information on the development or addition of training courses, or any information related to your ACMOS training.

Limitations and/or Exclusions of Liability:
The client (or student) acknowledges and/or expresses and/or accepts and/or approves without reservation that:
Any content delivered by SBJ INTERNATIONAL, in any form whatsoever (ideas, concepts, protocols, advice, etc.) does not give rise to any promise or guarantee of any kind (results, benefits on well-being, success, performance, etc.)
SBJ INTERNATIONAL, its legal representatives, the authorized representatives of SBJ INTERNATIONAL, its partners, and its suppliers are not responsible for or make any promise or guarantee.
That, having read this information, the client (or student) is aware that some of the practical exercises proposed may not produce the desired results and that the client (or student) is solely responsible and completely free to decide whether to participate, continue, and/or stop practicing the exercises at any time.
The client is therefore solely responsible for their level of participation/involvement, their decisions, actions, and results. That it will not in any way seek to hold SBJ INTERNATIONAL, its legal representatives, partners, affiliates, suppliers, or authorized persons of SBJ INTERNATIONAL responsible for its level of participation/involvement, decisions, actions, or results.
SBJ INTERNATIONAL shall not be held liable, under any circumstances, for any loss or damage caused or alleged to be caused in connection with the use of its advice, products, or services, whatever it may be and in whatever form.
SBJ INTERNATIONAL does not offer any professional medical or psychological advice, and any content delivered by SBJ INTERNATIONAL, in whatever form (ideas, concepts, strategies, advice, etc.), cannot replace the advice and/or intervention of a professional duly authorized by a diploma recognized by the competent authorities. Therefore, SBJ INTERNATIONAL, its legal representatives, partners, affiliates, suppliers, and authorized persons cannot be held liable in any way whatsoever for damages of any kind (personal injury, financial damage, illness, death, etc.).
In any event, the liability of SBJ INTERNATIONAL, its legal representatives, partners, affiliates, suppliers, and authorized persons of SBJ INTERNATIONAL, shall be contractually limited, where applicable, to compensation that may not exceed the amounts incurred for the purchase of the training, whether for damages (including bodily injury) or losses incurred or for other causes.
That it is their sole and entire responsibility to cover themselves against potential risks, knowing that SBJ INTERNATIONAL does not take out insurance for medical care, and/or bodily injury and/or disability.
Article 14
Applicable Law:
All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to therein, shall be subject to French law.
